Mar. 31, 2006) (granting EPA’s motion to dismiss, or in the alternative, for summary judgment against a claim that EPA had the responsibility to establish a state’s TMDLs when that state was not developing the TMDLs adequately. EPA was under no statutory duty to consider the state’s pace of resolution).
- Sierra Club v. EPA, 162 F. Supp. 2d 406 (D. Md. 2001) (granting in part and denying in part both plaintiffs’ and defendant’s motion for summary judgment; finding that the EPA did not abuse its discretion when it allowed the State of Maryland to establish and implement its TMDLs).

Pennsylvania Commonwealth Court:
- Borough of Bedford v. Commonwealth, 972 A.2d 53 (Pa. Commw. Ct. Apr. 14, 2009). (denying Pennsylvania Department of Environmental Protection’s (DEP) request for summary relief because it was too early in the litigation to decipher whether DEP’s “Chesapeake Bay Tributary Strategy Implementation Plan for National Pollution Discharge Elimination System (NPDES) Permitting” was policy or regulation; granting petitioners’ motion to add new petitioners).

- House Bill 4153 Chesapeake Bay Program Reauthorization and Improvement Act (Amends the Clean Water Act to establish financial reporting requirements for restoration activities in the Chesapeake Bay watershed; requires program administrator to establish technical guidelines to be used by the Chesapeake Bay Nutrient and Sediment Trading Commission; establishes an independent Chesapeake Bay Nutrient and Sediment Trading Commission).
- House Bill 4337 Chesapeake Bay State and Local Backstop Limitation Act of 2012 (limits the authority of the Administrator of the Environmental Protection Agency to implement certain actions related to Chesapeake Bay watershed total maximum daily loads, and for other purposes).
- Senate Bill 2294 Chesapeake Bay Watershed Fairness Act of 2012 (Amends the Food Security Act of 1985 to authorize the Secretary of Agriculture (USDA) to provide technical assistance to a Chesapeake Bay state to: (1) assist in developing water quality goals; (2) assist in developing protocols to confirm producer or owner compliance with water quality laws; and (3) harmonize water quality trading technical guidelines in preparation for interstate trading.
